Don Pancho restaurant chain to pay $563,350 in back wages due to violations

After an investigation by the U.S. Department of Labor’s Wage and Hour Division (WHD), Don Pancho Mexican Restaurant will pay $563,350 in back wages to 120 employees after an investigation found minimum wage, overtime and recordkeeping violations of the Fair Labor Standards Act (FLSA) at three Tennessee locations in Jackson (1081 Vann Drive), Mount Juliet and Ashland City. The Department also assessed the restaurant a $683 civil penalty for violating the child labor provisions of the FLSA.

WHD investigators determined Don Pancho Mexican Restaurant – headquartered in Clarksville, Tennessee – kept a percentage of servers’ tips to offset the restaurant’s expenses, in violation of minimum wage requirements. The law prevents employers from keeping workers’ tips. Don Pancho also failed to record all of the hours employees worked, resulting in the employer’s failure to pay for those hours, triggering additional violations.

Don Pancho Mexican Restaurant also paid some kitchen workers flat salaries, regardless of the number of hours that they worked. This practice resulted in violations when those employees worked more than 40 hours in a workweek, but the employer failed to pay them overtime. Similar violations occurred for employees paid flat daily rates regardless of the number of hours they worked. WHD also found the employer failed to maintain records of cash payments made to employees, resulting in a recordkeeping violation.

Real Estate market report for Jackson & Madison County

New or existing homes for sale in Jackson in September stood at 50, compared to 73, for August 2020.

New construction homes sold January 1 through September 30, was 111.

The number of homes on the market, which includes all of Madison County through September 30, stood at 137 – August 123.

Average days on the market – January 1 through September 30, was 44.

The average sales price for a home year to date is $186,869.

C&C Wine & Liquor reopens at 2644 North Highland Avenue

C&C Wine & Liquor, 2644 North Highland Avenue, has reopened.

A fire leveled the business October 6, 2019.

The new building faces North Highland Avenue, and a drive-thru window has been added.

Bud Heath, who owns the business, opened the 8,000-square-foot facility in September, 2016, after relocating from 2030 North Highland Avenue.

Business hours are 8 a.m. to 10 p.m., Monday through Thursday; 8 a.m. to 11 p.m., Friday and Saturday, and 11 a.m. to 6 p.m., Sunday.

Renovation nears completion of Jackson Energy Authority facility on East College Street

Projections are Jackson Energy Authority will move its HR Department, IT Department and Call Center into a newly renovated building at 119 E. College St., in November.

It is also projected that renovations at the former administration building for Jackson Energy Authority will be completed at the end of October.

Furnishings are expected to arrive at the time renovations have been completed in the 23,300-square-foot facility.

The building also has an 800-square-foot basement.

JEA’s Board of Directors received three bids from Office Interiors, Memphis; A-Z Office Resource Inc., Jackson, and Workspace Interiors, Boca Raton, Florida.

JEA approved a low bid of $236,687.17 from Office Interiors of Memphis.

Damaged by a water leak in 2013, all interior rooms at the facility were removed by a demolition project, which was completed in 2014.

The Board authorized a contract with TLM Associates, Inc., for design services.

The estimated cost of renovation is $3,000,000.
