Local Nurse Practitioner John Michael Briley Surrenders License

john michael brileyAfter an investigation by the State of Tennessee Jackson Healthcare provider John Michael Briley, known as “Dr B” to many of his patients has surrendered his license. Briley was licensed as both a Nurse Practitioner and as an Advanced Nurse Practitioner. Briley operates the Primary Care Specialist, South, on South Highland Drive, Jackson TN. According to the State website it is the same as a revocation.

According to the report, in mid to late 2013 witnesses say Briley began acting oddly, occasional slurred speech, increased perspiration, unsteady gate. Witnesses say the behavior got worse in early 2014.

Around April 15, 2014 PCS office manager and staff, friends, and family members held an intervention with Briley, according to the report.  Witnesses say Briley appeared to be “Impaired” at the time.

According to the investigation, between July 2013 and February 2014, Briley called in prescriptions for 26 pints of Zutripro. Witnesses report seeing and photographing over 50 pint bottles in trashcans at the office.

Witnesses say Briley used employees to fill and pickup prescriptions, used employees names at pharmacies without their knowledge, signed other physicians names to documents, and committed numerous other violations of the law.

The report also states that some patients records were, in some cases, illegible and contained false information regarding dosing and medications administered to or received by the patient.

The State Board of Nursing conducted a lengthy investigation of Briley’s practice and found numerous alleged violations of law that according to the report included:

  • Unfit or Incompetent by reasons of negligence, habits or other
  • Addicted to alcohol or drugs to the degree to the degree of interfering with nursing duties
  • Unprofessional conduct

The report also alleges violations of 19 different Tennessee Compliance Rules and Regulations RULE 1000 – 01-.13(1)

  • Unauthorized use or removal of narcotics, drugs, supplies, or equipment from a healthcare facility.
  • Impersonating another licensed practitioner
  • Being under the influence of drugs, alcoholic beverages, which impair judgement
  • Assigning unqualified persons to perform functions of licensed persons

According to the report findings, Briley, who was represented by council, understood the allegations and the stipulated discipline and agreed the state would present evidence to prove the allegations.

Briley was not required to admit guilt but did agree with the discipline.

The consent order agreed to was signed by Briley and by the General Counsel for the Tennessee Department of Health.
