Although the overall jail population in Madison, Chester and Henderson counties has declined, Jody Pickens, District Attorney General, said he does not have a number of those released that comprises the district he serves.
“I believe that most if not all that have had their jail sentences suspended, were placed on some form of supervision,” Pickens said, “To be clear, I do not make the decision of who to release, but instead based upon lists provided to me by each of the jails in my district, I only recommend to the appropriate judge that the person be considered for release.
“The main factors that I consider in making a recommendation that the person be considered for release is whether based the individual’s criminal history, that person has a propensity for violence, is a threat to public safety, or is habitual offender who is likely to immediately commit a criminal act that would return them to custody and thereby possibly expose the jail population to covid-19.
“I cannot speak to what factors the Court considers in determining who to release.”
