Proposed Agreed order regarding Red Lobster’s violations –
1) Respondent admits that the Petitioner has jurisdiction of the matters contained herein
2) On April 19, 2024, Respondent received a citation in connection with a minor compliance check from the Tennessee Alcoholic Beverage Commission pursuant to Tenn. Code Ann. § 57-4-203(b)(1)(A), Sale to a Minor, 3rd offense
3) On November 16, 2023, Respondent received a citation in connection with a minor compliance check from the Tennessee Alcoholic Beverage Commission pursuant to Tenn. Code Ann. § 57-4-203(b)(1)(A) of Sale to a Minor 2nd Offense.
4) On July 21, 2022, Respondent received a citation in connection with a minor compliance check from the Tennessee Alcoholic Beverage Commission pursuant to Tenn. Code Ann. 57-4-203(b)(1)(B) of Sale to a Minor, 1st Offense.
5) As a result of the foregoing three citations, the guilt of which Respondent does not dispute, Respondent will agree to a suspension of its beer permit for a period of seven (7) days beginning on Tuesday, September 17, at 12:01 a.m., and ending on Monday, September 23, at 12:59 p.m.
6) On days of suspension, no sales of beer shall be allowed.
7) Petitioner agrees that Respondent may pay a fine in lieu of service of the suspension. The total amount of the fine shall be Five Thousand Dollars ($5,000) and shall be calculated as follows:
$1,000 for the first offense
$1,500 for the second offense
$2,500 for the third offense
8) Petitioner agrees that if Respondent pays the total amount of the fine by today, Monday, September 16, the suspension shall not be served.
