
MADISON Co, Tenn. (March 31, 2015) – The father of Dillon McGee has filed a lawsuit alleging wrongful death and civil rights violations. The suit stems from a fatal shooting of McGee by a Madison County Sheriff’s Deputy.
Chad McGee, is named as the plaintiff representing his son in the lawsuit filed Monday in U.S. District Court.
18-year-old Dillon McGee was fatally shot Sept. 26 by a Madison County deputy. Two deputies were present at the time of the shooting. The name of the deputy who fired the fatal shot has never been released officially.
The lawsuit identifies Thomas Knolton as the deputy who shot McGee.
Madison County, Madison County Sheriff John Mehr and deputy Thomas Knolton are all named in the suit as defendants.
Allegations in the suit include that excessive force led to the wrongful death of McGee and that the force was ultimately the result of practices, policies, and conduct of or within Madison County.
In February a grand jury declined to indict either of the deputies.
According to investigator statements released after the shooting, Dillon McGee was sitting in his car in the parking lot of a Maverick gas station with 19-year-old Robert Aspiranti. According to deputies when they approached McGee took off in the vehicle, almost running over an unnamed deputy. That deputy fired the fatal shots.
The lawsuit cites eyewitnesses, forensic evidence, the medical examiners report and autopsy and alleges Dillon McGee was shot in the back at close range while steering the vehicle away from the deputy who fired the gunshot.
